Gray v. Ballard

Petitioner seeks review of the district court's denial of his 28 U.S.C. 2254 petition for habeas relief. Defendant argued that his petition was not time-barred because it was filed within one year of his discovery of his petitions' factual predicates -- his incorrect blood type and factual findings in the Zain III report -- which he argues could not have been discovered sooner. The court found, however, that had petitioner exercised due diligence, he would have discovered the factual predicates far earlier.
