Relator filed a qui tam action under the False Claims Act (FCA), 31 U.S.C. 3729 et seq., alleging that his former employer, NCED, along with other defendants, defrauded the government through various schemes in connection with contracts pursuant to the Javits-Wagner-O'Day Act, 41 U.S.C. 8501 et seq. After NCED and its former CEO settled, the district court dismissed relator's claims against the remaining defendants. The court held that the public-disclosure bar deprived the district court of jurisdiction over relator's claims against Defendants NISH, Green Bay, IPC, and Smurfit. With respect to these defendants, the district court properly determined that relator's proposed amendments to his first amended complaint were futile. The court held that relator's second amended complaint failed to adequately plead an FCA claim against Defendant Weyerhaeuser. Relator filed suit against certain student loan corporations, alleging that they defrauded the Department of Education and thus violated the False Claims Act (FCA), 31 U.S.C. 3729 et seq. After applying the arm-of-the-state analysis on remand, the district court again concluded that all of the student loan corporations constituted state agencies not subject to suit under the Act and granted their motions to dismiss. Applying the arm-of-the-state analysis to the corporations, the court vacated the judgment of the district court as to PHEAA and remanded to permit limited discovery on the question of whether PHEAA was truly subject to sufficient state control to render it a part of the state; vacated the judgment with respect to VSAC and remanded to permit limited discovery; and affirmed the judgment with respect to ASLA because it is an arm of Arkansas and therefore not subject to suit under the FCA. Carnell, a "minority-owned" corporation, filed suit against the Housing Authority and Blaine based on claims of race discrimination, retaliation, and breach of contract. The court held that a corporation can acquire a racial identity and establish standing to seek a remedy for alleged race discrimination under Title VI of the Civil Rights Act of 1964, 42 U.S.C. 2000d, but that the district court properly dismissed one of the defendants from liability on plaintiff's race discrimination claims; the district court abused its discretion in permitting the use of particular impeachment evidence, which should have been excluded as unfairly prejudicial under Federal Rule of Evidence 403; and the district court properly reduced certain damages awarded to plaintiff on its contract claims, but decided that the strict notice requirements of the Virginia Public Procurement Act, Virginia Code 2.2-4300 through 4377, required the court to narrow further the scope of recoverable contract damages. Plaintiffs filed suit against defendants, companies that contracted with the government to provide certain services at military bases in Iraq and Afghanistan, contending that they suffered harm as a result of the contractors' waste disposal and water treatment practices. The district court dismissed plaintiffs' state tort and contract claims prior to discovery, holding that the claims were nonjusticiable, the contractors were immune from suit, and federal law preempted the state tort laws underlying plaintiffs' claims. Relators filed suit in district court asserting claims arising from a Direct Procurement Method (DPM) scheme. The DOD instituted the International Through Government Bill of Lading program to govern transoceanic moves, while relying on the DPM to contract for transport strictly on the European continent. These appeals and cross-appeals were taken from final judgments, entered in accordance with Rule 54(b), in two qui tam actions consolidated for litigation in district court. The court concluded that relator possessed standing to sue for civil penalties while bypassing the prospect of a damages award and, therefore, the court affirmed the district court's judgment in his favor; the court reversed and remanded to the extent that the district court denied relator discovery of any penalties; and the court vacated the district court's ruling in favor of the United States so that it could conduct further proceedings on what remained of the government's FCA claim and reentered judgment as appropriate. DynCorp contracted with the U.S. Department of State to assist in the development of a civilian police force in Iraq and subcontracted with PMC for operations and maintenance support. PMC filed suit against DynCorp alleging that DynCorp breached its contract with PMC by making payments to one account instead of another. The court affirmed the district court's dismissal of PMC's case against DynCorp as a sanction for its discovery malfeasance. The Village commenced this action against the Corps to require it to honor commitments made to the Village and other North Carolina towns when developing its plan to widen, deepen, and realign portions of the Cape Fear River navigation channel. The district court dismissed the complaint for lack of subject matter jurisdiction. The court agreed with the district court's holding that the Corps' failure to implement "commitments" made to the Village during development of the plans for the project was not final agency action subject to judicial review. The court also concluded that the alleged contracts on which the Village relied for its contract claims were not maritime contracts that justified the exercise of admiralty jurisdiction. Plaintiff filed a retaliation action under the False Claims Act (FCA), 31 U.S.C. 3729-3733, alleging that defendants, IST and its parent company, EDO, fired plaintiff because he reported IST to the government for what he believed to be fraudulent conduct. IST is a New Hampshire corporation that designs and manufactures counter-improvised explosive devices (C-IEDs) for the government. Plaintiff, hired by IST as an engineer, made complaints regarding what he perceived as the failure of Mobile Multi-Band Jammer systems (MMBJs) devices to function properly at elevated temperatures. The court held that plaintiff's purported investigation activities did not raise a distinct possibility of a viable FCA action and were not protected; the court could not say that IST made a material false certification of compliance with government contracts; and plaintiff's complaint about IST did not raise a distinct possibility of a viable FCA claim. Plaintiff filed a qui tam lawsuit under the False Claims Act (FCA), 31 U.S.C. 3729, alleging that defendants fraudulently billed the United States for services provided to the military forces serving in Iraq. On appeal, plaintiff challenged the district court's dismissal of his complaint with prejudice. Because the court concluded that the district court had subject matter jurisdiction and the court found that the Wartime Suspension of Limitations Act (WSLA), 18 U.S.C. 3287, applied to this action, the court reversed. Because it could be appropriate for the district court to make factual findings to consider the public disclosure claim urged by defendants the court remanded so the district court could consider this issue. In this case, a subcontractor to a subcontractor to a prime contractor with a federal agency brought a procedural due process claim against that agency and tort actions against a separate contractor for allegedly causing the termination of his at-will consulting agreement. The court concluded that plaintiff's case involved both the wrong defendants and the wrong claims. Because permitting these claims to go forward would reward artful pleading and impermissibly constitutionalize state tort law, the court affirmed the district court's grant of summary judgment to defendants.
